2. ACCEPTANCE OF GENERAL TERMS AND CONDITIONS OF SALE

2.1 All orders placed on the Site are subject to these General Terms and Conditions of Sale (the "GTCS").

2.2 The customer declares that they are an individual aged at least 18 and possess the legal capacity to enter into a contract, or hold authorization allowing them to place an order on the Site (the "Customer").

In the event of an order for alcoholic beverages, the Seller reserves the right to request proof of age from the Customer and to cancel the order if there are legitimate grounds to believe that the Customer is a minor.

The Customer declares that they are acting for personal use or, when acting in a professional capacity, for the purposes of their business activity, and agrees not to resell any ordered products or services without authorization. 2.3 These General Terms and Conditions of Sale are binding on the Customer, who acknowledges—by checking the designated box—having read and accepted them prior to placing an order. The applicable terms are those in effect on the date the order is formally confirmed.

3. CONDITIONS OF SALE

3.1 The products and services offered on the Site are sold by the Seller, who determines or approves their essential characteristics, price, and conditions of use. The sales contract is concluded between the Customer and the Seller.

The Seller handles order processing, after-sales service, and complaint management. The Seller bears contractual responsibility for the proper performance of the services marketed on the Site.

3.2 The Restaurant participates in the physical execution of certain services as a partner of the Seller. Other culinary partners selected by the Seller may also contribute to the fulfillment of the offers provided.

3.3 Payments made by the Customer are collected by the Seller on its own behalf in exchange for the ordered products or services.

4. PRODUCTS AND SERVICES

4.1 Each product or service offered on the Site is accompanied by a description enabling the Customer to understand its essential characteristics prior to ordering, in accordance with the Consumer Code. This information covers, in particular, the nature of the offer, any allergens present, and—where relevant—instructions for storage, reheating, or use.

4.2 Photographs and visual images on the Site are for illustrative purposes only. They do not constitute a contractual commitment, provided that the delivered or performed service remains consistent with its essential characteristics.

4.3 Products and services are offered subject to availability. In the event of unavailability following an order, the Customer will be informed as soon as possible. An alternative solution, rescheduling, a credit note, or a refund may be offered, depending on the nature of the specific offer.

4.4 The composition of dishes may vary based on the season, ingredient availability, the chef's inspiration, or operational constraints, provided that the nature, standard, and spirit of the ordered service are maintained.

4.5 Where instructions regarding storage, reheating, or serving are required, they are provided with the products or communicated to the Client via any appropriate means.

5. PRICES

5.1 Prices are quoted in euros, inclusive of all taxes, excluding any delivery or processing fees, which are specified prior to order confirmation.

5.2 The total amount payable by the Client is displayed on the order confirmation page prior to final confirmation.

5.3 The Seller reserves the right to modify prices at any time. The order is billed based on the rates in effect on the day the order is placed.

5.4 Payment in full is due upon order confirmation, unless specific terms have been agreed upon with certain business clients.

6. REUSABLE CONTAINERS – SECURITY DEPOSIT

Certain offers are delivered in reusable containers (cast-iron pots, ceramic dishes, etc.). A credit card pre-authorization or a security deposit may be required from the Client prior to order confirmation. The deposit amount and the return deadline are specified on the product page and reiterated before confirmation.

This sum is not deb

...only in the event of failure to return the item within the announced timeframe or abnormal deterioration attributable to the Customer.

Return may be made directly to the Restaurant or via the delivery service provider, in accordance with the procedures communicated at the time of the order.

7. GIFT CARDS

7.1 Nature The gift cards offered on the Site allow the holder to receive a service at the Restaurant selected by the Seller: a set menu, a gastronomic experience, a product, or any other eligible offer. They constitute a right to a service issued by the Seller. They do not constitute electronic money or a payment service.

7.2 Validity Gift cards are valid for the duration specified at the time of purchase. This period begins upon order confirmation.

7.3 Use Gift cards are used in accordance with the terms indicated on the Site. They may be applied to a specific offer or allow the beneficiary to choose from the eligible offers available.

7.4 Reassignment and extension Subject to the conditions specified on the Site, a gift card may be reassigned to a different offer or have its validity extended, in accordance with the procedures, timeframes, and any applicable fees indicated at the time of the request. Unless otherwise stated, each of these operations may be performed only once.

7.5 Unavailability of the initial offer If the initially ordered offer cannot be fulfilled—particularly in the event of the Restaurant’s temporary or permanent closure, prolonged unavailability, or physical impossibility—the Seller shall offer the Customer or beneficiary a replacement solution, reassignment, extension, a credit note, or, failing a satisfactory solution, a refund under the conditions provided by law. 7.6 Refunds Gift cards are non-refundable, except in the event of a valid exercise of the statutory right of withdrawal or where the law mandates a refund.

8. ORDERING AND PAYMENT

8.1 The Customer selects the desired products or services, adds them to their cart, and then confirms their order. Before final confirmation, the Customer may review the order details and total price, and correct any errors.

8.2 The Customer provides the information necessary to process the order, including contact details, email address, and—where applicable—delivery and billing information.

8.3 Payment is made immediately upon placing the order via a secure payment service provider.

8.4 The Seller reserves the right to suspend or cancel any order in the event of incorrect information, an abnormally high order value, non-payment, a payment issue, or suspected fraud.

8.5 Confirmation of the order via payment constitutes acceptance of these General Terms and Conditions of Sale and forms the contract. A confirmation email is sent to the Customer as soon as possible.

9. DELIVERY

9.1 The delivery zones covered are indicated on the Site or in the product descriptions.

9.2 Delivery is carried out according to the terms specified at the time of the order.

9.3 If the Customer is absent at the agreed time and place, the Seller shall not be held liable for the inability to deliver the products due solely to the Customer's actions. Depending on the nature of the products, a new delivery may be arranged, potentially at the Customer's expense.

9.4 The Seller shall not be held liable for consequences resulting from incorrect or incomplete information provided by the Customer. 10. PRODUCT STORAGE

Deliveries are made using packaging suited to the nature of the products in order to maintain them in optimal conditions until handover to the Customer.

Following delivery, it is the Customer's responsibility to strictly adhere to the storage instructions provided with the products.

The Seller shall not be held liable for product deterioration resulting from improper storage, Customer negligence, or failure to follow reheating or consumption instructions.

11. WARRANTIES AND QUALITY

11.1 All products sold on the Site are covered by the statutory warranty of conformity and the warranty against hidden defects, under the conditions set forth in applicable regulations.

11.2 If the Customer is not fully satisfied with the quality of the delivered products or identifies a lack of conformity, they are encouraged to contact Customer Service as soon as possible at contact@ochre.fr, enclosing any relevant supporting documentation. Depending on the circumstances, a replacement, a credit note, or a refund may be offered.

11.3 The Seller is liable to the Customer for the quality, conformity, and proper performance of the services sold on the Site, including where such services are physically carried out by the Restaurant or a partner.

11.4 However, the Seller cannot guarantee...

...guarantee that the products or services will meet the purely subjective taste preferences of each consumer.

12. RIGHT OF WITHDRAWAL

12.1 Perishable products: In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised for products liable to deteriorate or expire rapidly.

12.2 Non-perishable products and gift cards: Where provided for by law, the consumer Customer has a period of fourteen days to exercise their right of withdrawal. Regarding gift cards, this right may be exercised within fourteen days of receipt, provided they have not been used, reassigned, or redeemed for a reservation.

12.3 Procedures: To exercise this right, the Customer must send a request to contact@ochre.fr before the applicable deadline expires. In the event of a valid withdrawal, the refund will be issued within the statutory timeframe, using the same payment method used for the order, unless otherwise agreed.

13. LIABILITY

13.1 The Seller is liable to the Customer for the conformity of the products and services sold and for their proper performance, including where such performance is physically carried out by the Restaurant or by a partner.

13.2 This liability shall not apply in cases of improper storage or misuse of the products by the Customer, incorrect information provided by the Customer, force majeure as defined in Article 1218 of the Civil Code, or acts attributable exclusively to the Customer or to a third party unconnected to the performance of the service.

13.3 For professional Customers, the Seller's total liability regarding an order shall not exceed the amount actually paid for said order. This limitation does not apply to consumer Customers.

13.4 Nothing in these General Terms and Conditions of Sale is intended to, or shall have the effect of, excluding or limiting the Seller's liability for personal injury, gross negligence, willful misconduct, or in cases where such exclusion or limitation is prohibited by law.

14. PERSONAL DATA

Customers' personal data is processed in accordance with applicable regulations. Details regarding data collection, use, and retention are set out in the privacy policy available on the Site.

For any questions, the Customer may write to contact@ochre.fr.

15. INTELLECTUAL PROPERTY

All elements appearing on the Site—texts, visuals, photographs, trademarks, logos, graphics, and content—are protected by intellectual property rights and remain the property of their respective owners.

Any reproduction, representation, adaptation, or use without prior written authorization is prohibited.

16. PARTIAL INVALIDITY

If any provision of these General Terms and Conditions of Sale is declared invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect, unless the fundamental structure of the contract is thereby disrupted.

17. GOVERNING LAW AND DISPUTES

These General Terms and Conditions of Sale are governed by French law.

In the event of a dispute, the Customer is encouraged to contact the Seller to seek an amicable resolution. Failing this, disputes shall be submitted to the competent courts in accordance with applicable law. 18. LEGAL NOTICE
